General terms and conditions

1. Scope

These general terms and conditions apply to all services provided by YELLOW PROJECTS Bau- und Projektmanagement GmbH, Dipl.-Ing. Alexandru Ialău, Baugutachter & Bausachverständiger. They apply equally to consumers and businesses, unless expressly agreed otherwise.

2. Subject of the contract

The subject of the contract is the provision of independent technical expertise in the construction field. The service may in particular include:

• on-site inspection;
• technical analysis;
• documentation of findings;
• preparation of a written expert report.

In particular, the following are not part of the contract:

• repair or renovation work;
• construction execution or supervision;
• legal advice;
• representation in disputes.

3. Conclusion of contract

The contract is concluded by:

• written order from the client;
• subsequent confirmation by the service provider.

Preliminary discussions, initial reviews, or general information do not constitute conclusion of a contract.

4. Client’s cooperation obligations

The client undertakes to provide all information and documents relevant to the expertise. These include in particular:

• access to the property;
• existing plans or documents;
• information on previous damage or measures already taken.

Incomplete or incorrect information may affect the assessment.

5. Fees

Fees depend on:

• type and scope of the commissioned service;
• complexity of the situation;
• time required.

Before ordering, a transparent cost estimate or quotation is usually provided.

6. Liability

The expertise is prepared to the best of professional knowledge and conscience, based on circumstances identifiable at the time of investigation. The service provider is liable for damage only in cases of intent or gross negligence. In cases of simple negligence, the service provider is liable only for breach of essential contractual obligations and limited to foreseeable, typical contract damage.

There is in particular no liability for:

• defects that cannot be identified or are hidden;
• changes to the property after the expertise;
• damage occurring after the expertise was performed.

7. Use of the expert report

The report is prepared exclusively for the client who commissioned it. Use by third parties or for purposes other than those agreed is at the client’s own risk, unless expressly agreed otherwise.

8. Final provisions

The law of the Federal Republic of Germany applies. If the client is a merchant, legal entity under public law, or special fund under public law, the competent court is the service provider’s registered office, insofar as permitted by law.
